GENERAL TERMS AND CONDITIONS OF SALE
These terms apply to all sales of used golf clubs on Webuy.golf. We comply with the Consumer Protection Act 68 of 2008 (CPA). We explain these terms to you in plain language before you agree. If anything is unclear, ask us. You can cancel within 5 business days if bought remotely (CPA Section 16). For buys, you have rights to safe, good quality goods (CPA Section 55) and implied warranty (CPA Section 56). We disclose all known defects. No unfair clauses—disputes go to the National Consumer Commission if unresolved.
Subject to the CPA and other laws, when buying or selling golf clubs with Webuy.golf, you understand and agree that:
- The club's specifications are suited for its intended purpose as a used golf club. You confirm you had enough opportunity to view photos, descriptions, and request inspection before buying.
- You have familiarised yourself with the condition of the club and are satisfied with it based on our disclosures.
- We do not warrant that the club is free of defects or meets new manufacturer specs, unless we expressly include a warranty in the sales agreement. All clubs are sold "as is" with full disclosure of known issues (e.g., wear, grips). If a manufacturer warranty remains, you must transfer it yourself.
- The club will only be delivered (or payment made for sells) after full payment clears, as per the invoice. For sells, we pay instantly via EFT once final offer agreed post-inspection.
- golf handles basic cleaning/regripping but is not obligated to certify or modify clubs beyond what's stated.
- We do our best to provide accurate descriptions (brand, model, condition) but do not accept liability for minor errors. We disclose if a club has known damage or repairs.
- For sells: You declare that you are the lawful owner of the clubs, they are not stolen or encumbered, and you indemnify Webuy.golf against any claims (e.g., theft, liens). We may require ID verification (e.g., SA ID copy) at inspection and reserve the right to refuse if suspicions arise (reported to SAPS). No proof of purchase needed, but false declarations void the deal and may lead to legal action.
- In disputes (e.g., over condition or offer), try resolving with us in 10 business days. If not, refer to the National Consumer Commission (NCC) or Consumer Goods and Services Ombud for investigation and recommendation (CPA Section 69).
- We charge a small documentation/handling fee on transactions, clearly displayed on quotes/invoices (e.g., R100 for shipping/inspection).
- We explain these terms before you sign/agree (digitally or in-person). By agreeing, you confirm understanding. Terms are available on our site and emailed.
- It's unreasonable to expect us to discover hidden defects in used clubs, as we market them (not manufacture). We disclose what we know from inspections. No liability for failures or consequential losses, except as per CPA (e.g., unsafe goods refund).
- Per our privacy policy (CPA Section 18), we process your info (name, contact, photos) securely and only for the transaction. You consent, but can withdraw (data deleted).
Additional CPA-Specific Clauses:
- Refunds/Returns: For buys, return within 7 days if defective (full refund/repair/replace per CPA Section 20/56). No "cooling off" for in-person sales, but yes for online. For sells, cancel before inspection—no fee.
- Warranties: Implied CPA warranty against defects for 6 months (repair/refund if major). Optional paid warranties available.
- Ownership/Stolen Goods: Sellers must sign declaration: "I own these clubs free and clear." We check ID at meet; if stolen suspected, we report and hold goods. This deters theft without mandatory receipts (which kill 50% conversions in used markets—common practice, per similar sites like Cash Converters).
- Governing Law: South African laws apply. Jurisdiction: Cape Town courts.
